Please read these Terms of Service (“Terms”) carefully before using the website located at fastnetnow.net or any associated client tools operated by FastNetNow (“Company,” “we,” “us,” or “our”). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

1. Acceptance of Terms

By visiting our website, submitting a contact form, or using any of our client-facing tools (Monitoring Dashboard, Helpdesk Portal, Remote Support), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, users, and others who access or use the services.

2. Description of Services

FastNetNow has provided technology services to Memphis-area businesses since 2001. Our services include, but are not limited to:

  • IT Consulting — strategic technology planning, server architecture, and deployment
  • Camera Installations (FastCamNow) — design, installation, and maintenance of IP and analog surveillance systems
  • Networking & Cabling — structured cabling design and installation (Cat5e, Cat6, fiber optic)
  • Managed Services — ongoing proactive management of client technology infrastructure
  • Monitoring Dashboard — real-time network and system health monitoring accessible at fastnetnow.net/dashboard
  • Helpdesk Portal — ticket-based IT support accessible at fastnetnow.net/helpdesk
  • Remote Support — agent-based remote desktop access via MeshCentral at support.fastnetnow.net

On-site services (consulting, installation, cabling) are governed by separate written agreements or statements of work executed between FastNetNow and the client. These Terms govern use of our website and online client tools.

3. Acceptable Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You must not:

  • Attempt to gain unauthorized access to any server, account, or system associated with this website.
  • Transmit any unsolicited commercial communications (spam), malware, or malicious code.
  • Use any automated tool (scraper, bot, crawler) to harvest content or data from this website without our prior written consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Engage in any activity that disrupts or interferes with the availability or performance of the website or its underlying infrastructure.
  • Submit false or misleading information through the contact form or any client portal.

We reserve the right to block access to any user or IP address that violates these terms, at our sole discretion and without prior notice.

4. User Accounts

Access to the Monitoring Dashboard and Helpdesk Portal requires a user account created by or in coordination with FastNetNow. If you are provided an account, you agree to:

  • Keep your credentials confidential and not share them with any unauthorized party.
  • Notify us immediately at [email protected] or (901) 870-3416 if you suspect unauthorized use of your account.
  • Use the account only for its intended business purpose — monitoring and managing the technology services FastNetNow provides to you.
  • Accept responsibility for all activity that occurs under your account credentials.

We reserve the right to suspend or terminate any account that we believe is being used in violation of these Terms or in a manner that could harm our systems or other clients.

5. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, button icons, images, audio clips, and software — is the property of FastNetNow or its content suppliers and is protected by applicable United States and international copyright laws.

The FastNetNow name, logo, and the “FastCamNow” service name are trademarks of FastNetNow. Nothing on this website grants you any license to use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and view the content on this website for your own personal or internal business purposes only. This license does not permit reproduction, distribution, modification, sale, or commercial exploitation of any site content.

6. Disclaimer of Warranties

This website and all information, content, materials, and services included on or otherwise made available through this website are provided on an “as is” and “as available” basis, without any representations or warranties of any kind, express or implied.

To the fullest extent permitted by applicable law, FastNetNow disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Service Level Expectations

FastNetNow operates the Monitoring Dashboard, Helpdesk Portal, and Remote Support tools on a best-effort basis. While we strive for high availability, we do not guarantee any specific uptime percentage for these client-facing tools through these Terms alone. Formal uptime commitments, SLAs, and response-time guarantees are established exclusively within the scope of individual written service agreements between FastNetNow and each client.

Scheduled maintenance windows and unplanned outages may occur. We will make reasonable efforts to provide advance notice of scheduled maintenance via the Helpdesk Portal when feasible. FastNetNow is not liable for damages arising from temporary unavailability of the website or client tools.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FastNetNow and its officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or the cost of substitute services — arising from or related to:

  • Your use of, or inability to use, this website or any client tool
  • Any unauthorized access to or alteration of your data
  • Any content or data obtained through the website
  • Any other matter relating to the website or services described herein

In no event shall FastNetNow's total liability to you for all claims arising from or related to use of the website exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow limitations on implied warranties or liability for consequential damages, so these limitations may not apply to you.

9. Payment Terms

Use of this website is free of charge. The services listed in Section 2 are billed separately pursuant to individual service agreements, proposals, or statements of work executed between FastNetNow and the client. Payment terms, rates, and billing cycles are defined within those individual agreements. Nothing on this website constitutes a binding price quote or commitment to provide services at any specific rate.

10. Termination

We may suspend or terminate your access to the website, client portals, or any associated services at any time, with or without cause, and with or without notice, effective immediately. Causes for termination include but are not limited to violation of these Terms, non-payment under a service agreement, or any activity that we determine poses a risk to the security or availability of our systems or other clients. Termination of a client-tool account does not automatically terminate any active service agreement, which is governed by its own terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or your use of the website shall be subject to the exclusive jurisdiction of the state and federal courts located in Shelby County, Tennessee.

Before initiating any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will make a good-faith effort to resolve any dispute within 30 days.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of our website or client tools after any modification constitutes your acceptance of the revised Terms. We encourage you to review this page periodically so that you are aware of any changes.
